Terms of use, privacy, and the legal disclosures that govern how ShareTax operates. Effective 17 March 2026 · ShareTax Pty Ltd · New South Wales, Australia.
1. Acceptance of Terms
By accessing or using the ShareTax service (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the Service. These Terms constitute a binding agreement between you and ShareTax Pty Ltd (“ShareTax”, “we”, “us”, “our”).
We may update these Terms from time to time. Continued use of the Service after any changes constitutes your acceptance of the revised Terms.
2. Description of Service
ShareTax is a Capital Gains Tax (CGT) calculation tool designed for individual Australian investors in publicly listed equities. The Service allows users to:
- Import broker trade data (CSV/XLSX format)
- Calculate CGT obligations using the FIFO method under ATO guidelines
- Generate CGT reports in PDF and Excel format
- Model portfolio performance and tax projections
Important: ShareTax is a computational tool only. It does not constitute financial advice, tax advice, or legal advice. ShareTax is not a registered tax agent under the Tax Agent Services Act 2009 (Cth).
The Service is intended for use by Australian tax residents only. ShareTax does not represent that the Service is appropriate or available for use in other jurisdictions.
3. User Accounts
Registration
To access most features, you must create an account by providing a valid email address and password. You agree to provide accurate, current, and complete information and to keep your account details up to date.
Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at support@sharetax.com.au if you suspect unauthorised use of your account.
Guest Accounts
ShareTax may offer limited guest access. Guest account data is automatically deleted after 24 hours. Guest users acknowledge this data is temporary and assume full responsibility for any data they enter.
Account Eligibility
You must be at least 18 years old to create an account. By registering, you represent and warrant that you meet this requirement.
4. Subscription & Payment
Subscription Plans
ShareTax offers both free and paid subscription tiers. Paid plans are subject to the fees and features described on our pricing page at the time of purchase. We reserve the right to modify pricing with at least 30 days’ notice to existing subscribers.
Billing
Paid subscriptions are billed in advance on a monthly or annual basis. Payment is processed by Stripe. By subscribing, you authorise ShareTax to charge your nominated payment method on a recurring basis until you cancel.
Refunds
If you cancel within 14 days of your initial subscription purchase and have not generated any reports, you may request a full refund by contacting support@sharetax.com.au. No refunds are provided for partial billing periods after this window.
Failed Payments
If a payment fails, we will attempt to notify you by email. Your account may be downgraded to a free tier if payment is not resolved within 7 days.
5. Acceptable Use
You agree to use the Service only for lawful purposes. You must not:
- Use the Service to facilitate, assist, or conceal money laundering, tax evasion, or any other financial crime
- Import fabricated, falsified, or manipulated trade data
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Attempt to gain unauthorised access to any system, server, or data associated with the Service
- Use the Service in a manner that could damage, disable, or impair its operation
- Share your account credentials with third parties, except where expressly permitted (e.g., authorising an accountant via the client portal)
- Use the Service on behalf of or for the benefit of third parties without their explicit consent
We reserve the right to suspend or terminate accounts engaged in prohibited use without notice.
6. Intellectual Property
All content, features, and functionality of the Service are owned by ShareTax Pty Ltd and are protected by Australian and international copyright, trademark, and other intellectual property laws.
You retain ownership of the trade data you upload. By using the Service, you grant ShareTax a limited, non-exclusive licence to process your data solely for the purpose of providing the Service to you.
Reports and outputs generated by the Service are provided for your personal use only. You may not re-sell, distribute, or commercially exploit outputs without our written consent.
7. Disclaimer of Warranties & Limitation of Liability
Disclaimer
The Service is provided “as is” and “as available” without warranties of any kind. ShareTax does not warrant that:
- The Service will be uninterrupted, error-free, or free from viruses
- Calculations will be accurate, complete, or suitable for your specific circumstances
- The Service will meet ATO requirements in all individual circumstances
Limitation of Liability
To the maximum extent permitted by law, ShareTax and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:
- Errors or omissions in CGT calculations
- ATO penalties, interest, or assessments arising from reliance on Service outputs
- Loss of data or business interruption
Where liability cannot be excluded by law, our total aggregate liability is limited to the greater of (a) the fees you paid to ShareTax in the 12 months preceding the claim, or (b) AUD $100.
Your Responsibility
You acknowledge that you remain solely responsible for reviewing all outputs and for the accuracy of any information submitted to the Australian Taxation Office.
8. Data & Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
We implement reasonable security measures to protect your data. No method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
9. Termination
By You
You may close your account at any time by contacting support@sharetax.com.au. Upon account closure, your data will be retained in accordance with our data retention policy (7 years for ATO record-keeping purposes, then permanently deleted).
By ShareTax
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we believe you have violated these Terms, applicable law, or if we discontinue the Service.
Effect of Termination
Upon termination, your right to use the Service ceases immediately. Sections 6 (Intellectual Property), 7 (Liability), and 11 (Governing Law) survive termination.
10. Changes to Terms
We will provide at least 14 days’ notice of material changes by email to registered users. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.
Before initiating formal proceedings, contact us at support@sharetax.com.au and allow 30 days to attempt to resolve the dispute in good faith.
Nothing in these Terms limits your rights under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)).
